AC Rewards Tracker (“AC Rewards Tracker,” “we,” “our,” or “us”) provides a reward tracking and expiration reminder service through its website located at acrewards.app (“Site,” and together with such service, including any updated or new features, functionality and technology, collectively the “Services”). The Services are provided on a free-to-use basis with optional donation support.

By using our Services, you (“you,” “your,” or “User”) agree to these Terms of Service. Please read them carefully as they constitute a legal agreement between you and AC Rewards Tracker.

The Services are designed to work with publicly available information about airline reward programs and do not require or access your actual airline accounts.

4.2 Service Availability

While we strive to maintain high service availability, AC Rewards Tracker is provided on an “as available” basis. We may experience occasional downtime for maintenance, updates, or due to factors beyond our control. We do not guarantee uninterrupted access to our Services and reserve the right to modify, suspend, or discontinue any aspect of our Services at any time. 7.2 Termination

You may terminate your use of our Services at any time by discontinuing use and, if desired, deleting your account through the dashboard settings. We may terminate or suspend your access to our Services immediately if you violate these Terms, engage in activities that could harm our Services or other users, or for any other reason at our sole discretion. Upon termination, your right to access and use our Services ceases immediately. We will make reasonable efforts to provide you with an opportunity to export your data before account deletion, but we are not obligated to retain your data after termination.

All content, features, and functionality of AC Rewards Tracker, including but not limited to text, graphics, logos, icons, images, audio clips, digital downloads, data compilations, and software, are the exclusive property of VKT IT SERVICES FZCO or its licensors and are protected by copyright, trademark, patent, trade secret, and other intellectual property laws.

You retain ownership of any content you submit to our Services, including reward information and personal data. By submitting content, you grant us a limited, non-exclusive license to use, store, and process such content solely for the purpose of providing our Services to you. We strive to provide reliable and accurate Services, but we make no warranties regarding the completeness, accuracy, or reliability of any information provided through our Services. We do not warrant the accuracy of airline reward program information or expiration dates, as these may change without notice from the airline providers.

EXCEPT AS EXPRESSLY PROVIDED HEREIN, THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SERVICES ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL VKT IT SERVICES FZCO BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUES, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF THE SERVICES. OUR TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, AND CAUSES OF ACTION SHALL NOT EXCEED ONE HUNDRED DOLLARS ($100) OR THE AMOUNT OF ANY DONATIONS YOU HAVE MADE IN THE TWELVE MONTHS PRECEDING THE INCIDENT, WHICHEVER IS GREATER. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION MAY NOT APPLY TO YOU.

11. Indemnification

You agree to indemnify, defend, and hold harmless VKT IT SERVICES FZCO, its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including attorney’s fees) arising from: (a) your use of the Services; (b) your violation of these Terms; (c) your violation of any third-party rights, including without limitation any copyright, property, or privacy right; or (d) any claim that your User Data caused damage to a third party.

We do not endorse or assume any responsibility for any such third-party sites, information, materials, products, or services. Any dispute, claim, or controversy arising out of or relating to these Terms or the breach, termination, enforcement, interpretation, or validity thereof shall be resolved in the courts of the United Arab Emirates. You hereby consent to the jurisdiction of such courts and waive any objection to the laying of venue in such courts.

These Terms, together with our Privacy Policy and any other legal notices published by us on the Services, constitute the entire agreement between you and AC Rewards Tracker regarding the Services and supersede all prior and contemporaneous agreements, proposals, or representations, written or oral.

If any provision of these Terms is held to be invalid, illegal, or unenforceable, the validity, legality, and enforceability of the remaining provisions shall remain in full force and effect.
